INTERNSHIP AGREEMENT

 

 between:

ABC (Pty) Ltd (“the Company”)

The parties hereby agree that the following terms and conditions govern the internship relationship:

1.  Purpose

The purpose of the agreement is to provide the Intern with:

a. Appropriate exposure to a workplace environment;

b. Training in the relevant areas of the business in line with the Interns studies;

c. Practical experience relevant to the Interns studies and operationally viable to the Company.

2.  Internship Period and Place of Work

a. The internship shall commence on Date until Date unless terminated earlier in terms of paragraph 8.

b. The initial 3-month period until Date will be considered as a probation period. This affords both parties an opportunity to assess the organisational fit as well as a fit with the fundamental competencies required for the role. [Optional clause]

c. On completion of the internship period as detailed above, this contract will automatically terminate. Such termination shall not be construed as being retrenchment or redundancy but shall be completion of the internship.

d. The Intern is advised that this is not a permanent position and that no expectation of permanency should be created unless an offer of employment is issued in writing by the Managing Director.

e. It is furthermore expressly agreed that any renewals of this internship contract will not create any expectations or rights to further renewals in the future.  Neither will the Intern acquire any right to permanent employment if this contract is not renewed by the Company.

f. Signing of this agreement after commencement of the internship doesn't negate any benefits obtained prior to entering into this agreement.

g. The Internship will be served at the Company’s physical address as stipulated on Page 1 of this contract or such other place or places as the Company shall in good faith require.

3.  Stipend

a. The Intern will be paid a stipend of R 000.00 per month while gaining workplace experience.

b. The stipend will be paid at the end of each month in which workplace experience took place.

c. Payments will be made electronically into the Intern’s nominated bank account.

4. Company Responsibilities

a. The Company undertakes to provide the Intern with appropriate and structured training and access to resources.

b. Furthermore, the Company will mentor and guide the Intern in the development of key skills required in the workplace and relevant to their field of study.

c. The Company undertakes to ensure fair treatment and compliance with all relevant labour laws at all times.  

5. Interns duties

The Intern will be required to:

a. Perform duties in terms of this Agreement;
b. Comply with the Company’s rules and regulations as well as workplace procedures;
c. Follow instructions and complete work issued as part of the learning process;
d. Be available for and participate in all training and learning opportunities as required;
e. Complete any time sheets or any written assessments supplied by the Company to record relevant workplace experience.

6.  Obligations

The Intern has the following obligations:

a. In no way do anything which has or may have the effect of bringing the good name and reputation of the Company into disrepute.

b. To render any services arising from this Contract in a proper and professional manner.

c. Not to disclose any confidential information about the Company to anyone other than a director of the Company.

e. To apply themselves fully to the promotion of the interests of the Company, i.e. to declare any outside interests that may be in conflict with the interests of the Company.

f. To observe and obey all safety and security rules and regulations either in terms of company policy or prescribed by law.

7.  Working Hours & Leave

a. The Intern`s hours of work will be from 08h00 to 17h00, Monday to Thursday and from 08h00 to 14h30 on Friday which includes 30 minutes lunchtime per day, thus making it a total of 40 hours per week.

b. Paid leave will accrue at the rate of fifteen (15) working days in each twelve-month cycle of employment. Leave is to be taken at mutually agreed times. Leave Application forms must be completed and authorised, prior to taking any leave. Leave records will be maintained to ensure that the statutory requirements have been met.

c. The Intern will be entitled to one day`s paid sick leave in respect of every completed 26 days worked. A medical certificate must be produced for sick leave in excess of two consecutive days. Leave applications forms must be completed when applying for sick leave and leave records will be maintained to ensure that the statutory requirements have been met.

8.  Termination of this Contract

This Internship agreement terminates on the termination date stipulated in this Agreement or on an earlier date if:

a. The Intern does not successfully complete their probation period.

b. The intern is fairly dismissed by the employer for a reason related to the intern’s conduct or capacity;

c.  The employer and intern agree to terminate the Agreement.

d.  The intern resigns from the employer.

e.  In the event of a, b or c above, the following notice periods shall apply unless the Intern is summarily dismissed for reasons that are sufficient in terms of labour law:

1 (One) weeks’ notice during the first six months of employment.

2 (Two) weeks’ notice during the first year of employment.

4 (Four) weeks’ notice after the first year of employment.

9. Information Technology systems

The Intern is hereby informed that use of the Company’s telecommunication and information systems (including email and internet) may be subject to inspection by Management from time to time.  The Company’s computer resources are intended to be used for work related activities and in a manner which is consistent with the standard of conduct normally expected from employees.

10. Declaration

The Intern hereby acknowledges that he/she has declared and disclosed all information reasonably expected to influence the decision to offer an internship, e.g. license endorsements, criminal records or convictions, previous disciplinary sanctions, incapacity due to ill health etc.

11. General

a. Any changes to this agreement will only be valid if they are in writing and have been signed by both parties.

b. No indulgence granted by any party will constitute a waiver of any of that party's rights in terms of this agreement.

c. This agreement and all the provisions it contains are at all times subject to and superseded by The Labour Relations Act, The Labour Relations Amendment Act, Basic Conditions of Employment Act, Skills Development Act or any other law applicable at the time.
