The payment of workers who work on a Sunday is governed by Section 16 of the Basic conditions of employment Act:
Who does not qualify
 
The following employees are exempt from these payments:


1) Workers in senior management
2) Sales staff who travel and regulate their own working hours
3) Workers who work less than 24 hours in a month
4) Workers who earn more than R149 736 per year
5) Workers engaged in emergency work are excluded from certain provisions.
 
 
How to Pay
 
1) I don't normally work on a Sunday!
This employee must be paid at double his hourly rate
 
2) I normally work on Sunday!
This employee must be paid one and a half times his hourly rate
 
3) What happens if I don't work a full shift?
Then you need to pay the employ for a minimum one days work or the pay due whichever is the greatest
 
4) Can I exchange the payment for time off?
Yes you can at the same rate as you would have earned a wage E.G. for every hour worked you will receive 2 hours or 1, hours off. This needs to be granted to you within one month of your working the overtime. However this can be increased to a period of 12 months if there is an agreement in writing
 
5) What happens when my shift falls on a Sunday?
If the majority of your shift is worked on a Sunday then your whole shift will be paid at Sunday time, BUT if the majority of your shift is worked on a Saturday/Monday then your whole shift will be paid at normal time
